These Terms of Use ("Terms") govern your use of tohhealth.com (the "Site"), operated by The Optimized Human LLC ("The Optimized Human," "TOH," "we," "us," or "our"). The Site describes the Clinical Growth System™, our offer for gym owners, coaches, and chiropractors, including our Founding Partners.
By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Who may use the Site
The Site is for business owners and professionals who are at least 18 years old. If you use the Site on behalf of a business, you confirm that you have authority to accept these Terms for that business.
2. Using the Site
You may use the Site to learn about the Clinical Growth System, contact us, and book a call. When you use the Site, you agree not to:
- Break any law or violate anyone else's rights.
- Submit false or misleading information, or information about someone else without their permission.
- Try to gain access to private pages, accounts, or systems you are not authorized to use.
- Interfere with the Site, its security, or its hosting, including by sending malware or overloading it.
- Scrape, copy, or collect content or data from the Site using automated tools without our written permission.
- Use the Site to send spam or unsolicited messages.
We may suspend or block access to the Site at any time if we believe you have broken these Terms.
3. Illustrations, not guarantees
Everything on the Site is general business information. Revenue figures, calculators, example pricing, margins, medication costs, and other numbers are illustrations only. They are not promises, projections, or guarantees of results.
Your results depend on many things outside our control, including your market, your members, your pricing, your effort, and how you run your business. Many businesses do not earn the amounts shown. Medication costs are estimates and can change with pharmacy pricing.
Nothing on the Site is an offer that can be accepted. Pricing, terms, and any guarantee apply only as written in a signed agreement between you and TOH. If anything on the Site conflicts with a signed agreement, the signed agreement controls.
Nothing on the Site is legal, tax, financial, or accounting advice. Talk with your own advisors before making business decisions.
4. No medical advice
The Site does not provide medical advice, diagnosis, or treatment, and it does not create a doctor and patient relationship. Information on the Site about labs, hormones, peptides, weight loss medications, or other clinical services is general business information only.
Clinical services offered through the Clinical Growth System are provided by independent licensed providers. Licensed providers make all clinical decisions, including whether any person qualifies for any test, treatment, or medication. TOH and its partners coach and support; they do not diagnose or prescribe. No one is guaranteed to qualify for any medication or treatment.
If you have a medical question, talk with a licensed healthcare provider. If you have a medical emergency, call 911.
5. Communications
When you submit a form or book a call on the Site, you agree that TOH may contact you about your inquiry and the Clinical Growth System by email and phone call at the contact details you provide.
If you also agree to receive text messages, TOH may text you at the mobile number you provide. Consent to texts is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. See Section 4 of our Privacy Policy for full details.
You can opt out of marketing emails by using the unsubscribe link, and you can ask us to stop calling you at any time. You confirm that the contact information you give us is yours or that you are authorized to give it.
6. Private partner menu
Some pages, such as the partner menu, are private and protected by a login. Access is given only to people we approve, and only for evaluating or working with TOH.
Everything on private pages is confidential, including pricing, margins, suggested menus, provider details, and processes. You agree to:
- Keep that information confidential and use it only to evaluate or work with TOH.
- Not share, copy, screenshot, record, forward, or publish it, or give your login access to anyone else, without our written permission.
- Tell us right away if you believe someone has gained access without permission.
We may change or remove access at any time. These obligations continue after your access ends. If you sign a separate agreement with TOH that has its own confidentiality terms, those terms also apply.
7. Intellectual property
The Site and its content, including text, graphics, logos, videos, designs, and the names The Optimized Human, TOH, and Clinical Growth System™, belong to TOH or its licensors. They are protected by copyright, trademark, and other laws.
You may view the Site for your own business evaluation. You may not copy, change, distribute, sell, or create works based on any Site content without our written permission.
8. Information you send us
You are responsible for the information you submit through the Site. If you send us feedback or ideas, we may use them without any obligation to you. Our use of personal information is described in our Privacy Policy.
9. Third party links and tools
The Site links to and uses tools from other companies. For example, our inquiry form and booking calendar are provided by GoHighLevel (our CRM and scheduling platform), our videos are hosted by Loom, and our hosting and partner login are provided by Cloudflare.
We do not control these third parties and are not responsible for their content, services, availability, or privacy practices. Your use of their tools may be subject to their own terms and policies.
10. Disclaimers
The Site and all content are provided "as is" and "as available." To the fullest extent allowed by law, TOH makes no warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy, and non infringement. We do not promise that the Site will be uninterrupted, error free, secure, or free of harmful components, or that its content is complete or current.
11. Limitation of liability
To the fullest extent allowed by law, TOH and its owners, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from or related to the Site or these Terms. This applies even if we were told such damages were possible.
To the fullest extent allowed by law, our total liability for any claim related to the Site or these Terms will not exceed one hundred US dollars ($100). Some states do not allow certain limits on liability, so some of these limits may not apply to you.
12. Indemnity
You agree to defend, indemnify, and hold harmless TOH and its owners, employees, contractors, and partners from any claims, losses, and expenses (including reasonable attorneys' fees) that arise from your misuse of the Site or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law rules. Any dispute related to the Site or these Terms will be brought only in the state or federal courts located in Lexington County, South Carolina, and you agree to the jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Your continued use of the Site after an update means you accept the updated Terms.
15. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and TOH about your use of the Site. A separate signed agreement with TOH, such as a Founding Partner agreement, governs the services it covers.
