This Privacy Policy explains how The Optimized Human LLC ("The Optimized Human," "TOH," "we," "us," or "our") collects, uses, and shares information through tohhealth.com (the "Site"). The Site is our business website for the Clinical Growth System™, an offer for gym owners, coaches, and chiropractors, including our Founding Partners.
By using the Site or sending us your information, you agree to the practices described here. If you do not agree, please do not use the Site.
1. Who we are
The Optimized Human is a health transformation company based in South Carolina, USA, founded by Jay Soileau. You can reach us at jay@toh100.com or by mail at 317 N Carolina Ave, Batesburg, SC 29006.
The Site is meant for business owners and professionals. The information we collect is mostly business contact information that you choose to share with us.
2. Information we collect
Information you give us
When you fill out our Partner Inquiry form, we collect your name, gym or business name, email address, phone number, city, and member count.
When you book a call using our online calendar, we collect the information the booking form asks for, along with the date and time you choose.
When you email, call, or text us, we keep the content of those messages and your contact details so we can respond.
Information collected automatically
Visit and tracking data. Our customer relationship management (CRM) platform places a tracking script on the Site. It uses cookies and similar technologies to record the pages you visit and when you visit them. If you submit a form or book a call, this activity can be linked to your contact record.
Request and security data. Our hosting provider, Cloudflare, processes technical data each time you load a page. This can include your IP address, browser and device type, the pages you request, referring pages, dates and times, and security signals used to block abuse and attacks.
Partner menu login data. Our private partner menu page is protected by a Cloudflare Access login. When you sign in, Cloudflare processes the email address or sign in details used to verify your access, along with related login and security records.
3. How we use your information
We use the information we collect to:
- Respond to your inquiry and follow up with you by email, phone call, and text message (if you agree to texts).
- Schedule, confirm, and remind you about calls you book with us.
- Understand whether the Clinical Growth System is a good fit for your business.
- Send you information about the Clinical Growth System and related TOH business offers.
- Understand how visitors use the Site so we can improve it.
- Control access to private pages, such as the partner menu.
- Keep the Site secure and prevent fraud, spam, and abuse.
- Meet our legal obligations and enforce our Terms of Use.
4. Text messages (SMS)
If you give us your mobile number and agree to receive text messages, The Optimized Human may send you texts about your inquiry, calls you book, and the Clinical Growth System. These can include follow up messages, appointment confirmations and reminders, and information about our offers. We send these texts through GoHighLevel, our CRM and scheduling platform.
- Consent is not a condition of purchase. You do not have to agree to receive text messages to buy anything from us or to work with us.
- Message frequency varies.
- Message and data rates may apply. Check with your mobile carrier for details about your plan.
- Opt out at any time. Reply STOP to any message to stop receiving texts. We will send one message to confirm you have been unsubscribed, and then we will stop.
- Get help. Reply HELP to any message for help, or email us at jay@toh100.com.
- Mobile carriers are not liable for delayed or undelivered messages.
We never sell or share your mobile number or SMS opt in consent. No mobile information will be sold or shared with third parties or affiliates for their marketing or promotional purposes. Text messaging opt in data and consent are excluded from every category of sharing described in this policy. We share this information only with the service providers that help us send our own messages, and only for that purpose.
5. How we share your information
We do not sell your personal information. We share it only as described below.
Service providers. We use trusted companies to run the Site and our business. They may process your information on our behalf and only for the services they provide to us. These include:
- Cloudflare, which hosts the Site, protects it from attacks, and runs the login for the private partner menu.
- GoHighLevel, our CRM and scheduling platform. It powers our inquiry form, booking calendar, page tracking, contact records, and follow up messages.
- Loom, which hosts the videos linked or embedded on the Site. When you play or open a video, Loom may collect information under its own policies.
- Google Fonts, which delivers the fonts used on the Site. Your browser connects to Google servers to load them, which shares your IP address and browser details with Google.
- Email, phone, and text message providers and carriers that deliver our communications.
Legal reasons. We may share information if we believe it is required by law, subpoena, or court order, or needed to protect the rights, property, or safety of TOH, our users, or others.
Business transfers. If we are involved in a merger, sale of assets, or similar transaction, your information may be transferred as part of that deal. Any buyer will be bound by the SMS commitments in Section 4.
With your consent. We may share information for other purposes when you ask us to or agree to it.
The SMS opt in data and consent described in Section 4 are never shared under any of these categories, except with service providers who send our own messages.
6. Cookies and similar technologies
Cookies are small files stored in your browser. We and our service providers use cookies and similar technologies to keep the Site working and secure, to remember your choices, and to record page visits and connect them to contact records.
Our inquiry form includes a cookie consent notice. You can also block or delete cookies in your browser settings. If you do, some parts of the Site, such as the form, booking calendar, or partner menu login, may not work properly.
7. Do Not Track
Some browsers offer a "Do Not Track" setting. There is no common industry standard for how websites should respond to these signals, so the Site does not currently respond to them. You can still control cookies as described in Section 6.
8. How long we keep information
We keep personal information for as long as we need it for the purposes in this policy. That includes responding to you, maintaining our business relationship, keeping records of your communication preferences, and meeting legal, tax, and accounting requirements. When we no longer need it, we delete it or make it anonymous.
If you opt out of texts or emails, we keep a record of that choice so we can honor it.
9. How we protect information
We use reasonable administrative, technical, and physical safeguards to protect your information. These include encrypted connections to the Site, access controls on private pages, and limiting access to people and providers who need it. No method of storing or sending data over the internet is completely secure, so we cannot guarantee absolute security.
10. Your choices and rights
Marketing emails. Use the unsubscribe link in any marketing email, or contact us.
Text messages. Reply STOP to any text, or contact us.
Calls. Tell us during a call, or contact us, and we will stop calling you.
Access, correction, and deletion. You can ask us to tell you what personal information we have about you, give you a copy, correct it, or delete it.
State privacy rights. Depending on where you live, state privacy laws may give you additional rights. These can include the right to know what personal information we collect and how we use and share it, to access and get a copy of it, to correct it, to delete it, and to opt out of the sale of personal information, targeted advertising, or certain profiling. We do not sell personal information. We will not discriminate against you for using any of your privacy rights.
How to make a request. Email us at jay@toh100.com with the subject line "Privacy Request," or write to us at 317 N Carolina Ave, Batesburg, SC 29006. Tell us what you are asking for. We may need to verify your identity before we act, usually by confirming information we already have. An authorized agent may make a request for you if they show proof that you gave them permission. We will respond within the time required by applicable law.
Appeals. If we deny your request and your state gives you the right to appeal, reply to our decision or email us with the subject line "Privacy Appeal." We will review it and let you know the result.
11. Children
The Site is meant for business owners and professionals. It is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has given us information, contact us and we will delete it.
12. Visitors outside the United States
We are based in the United States and the Site is intended for visitors in the United States. If you use the Site from somewhere else, your information will be processed in the United States and in other places where our service providers operate.
13. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will change the "Last updated" date at the top of this page. If we make material changes, we may also give notice in other ways. Your continued use of the Site after an update means you accept the updated policy.
